This is a FAQ (Frequently Asked Questions) document designed to explain to our customers why we have made changes to our terms and what it means for them.

THE FAQ
Why have these changes been made?
There are two principle reasons for change:
We have recently added new products to the Betfair website, such as Betfair Casino and a new Betfair Poker offering. To reflect the various products Betfair now offers we have introduced a "global" set of terms and conditions to cover all products, which customers will acept when joining Betfair. The products covered by the Terms and Conditions are:
  • The main Betfair Exchange (now found under the "Sports" tab);
  • Betfair Poker;
  • Betfair Games; and
  • Betfair Casino.
  • (2) Changes to the Terms & Conditions have also occurred to reflect several issues that have arisen in the course of business over the last year. For example, we have added a paragraph confirming Betfair's longstanding policy of not accepting US customers or bets from the US. Further details of these changes are described below.
    What if I don't want to sign up for all of Betfair's products?
    Every Betfair customer will be bound by the "global" terms and conditions, so it is not possible to agree to the terms and conditions for only some of the products. However, the terms and conditions for each product only apply to the extent that you actually use any of the products. Therefore if you never play on Betfair Casino then the Betfair Casino terms won't apply to you.
    I don't agree to the Terms & Conditions and Privacy Policy! What are my rights?
    Unfortunately, further betting with Betfair will not be possible unless and until you agree. We must ensure that all our users are governed by the same terms. You may of course remove funds from your account without agreeing should you so wish.
    How do the changes impact on me?
    For all intents and purposes it will be business as usual for all. However, several changes to our Privacy Policy and Terms & Conditions may interest some customers, as explained below:
    Privacy Policy
    • The privacy policy now applies to all Betfair products. Although different companies in the Betfair group (responsible for the different products) may each have access to your personal data this will data will still be kept securely in accordance with the terms of the Privacy Policy.
    • We have also signed further Memorandums of Understanding for information sharing with regulatory bodies over the past year. These are listed in the Privacy Policy and, for example, include Racing Victoria Limited and Tasmanian Racing Services.
    Betfair Casino Terms and Conditions
    • These are brand new terms and conditions for Betfair's newest product, Betfair Casino. However they are very similar in substance to the terms for Betfair Games.
    Betfair Games Terms and Condition
    • These terms only have several minor changes, for example they reflect the fact that Betfair Hi-Lo has been introduced and that an API is now available for Betfair Games.
    • We have also re-affirmed in our terms the longstanding and continued policy that Betfair Games does not accept US customers or bets from the US.
    Betfair Poker Terms and Conditions
    • The changes here reflect the new Betfair Poker product that is now available. Betfair Poker is no longer attached to the Cryptologic network. Betfair Poker is now operated and managed by Betfair Poker Limited from Malta, which is ultimately owned by the parent company of the Betfair group – The Sporting Exchange Limited.
    • We have also re-affirmed in our terms the longstanding and continued policy that Betfair Poker does not accept US customers or bets from the US.
    Betfair Exchange ("Sports") Terms and Conditions
    • The terms and conditions are still with Betfair Limited which is intended to remain the operating company of the exchange; however Betfair has the right to appoint an agent in a different jurisdiction to operate the exchange at any time. For example, this may apply for disaster recovery purposes.
    • We have re-affirmed in our terms Betfair's longstanding and continued policy that we do not accept US customers or bets from the US. This applies for all Betfair products.
    • Customers are now obliged to verify that they are allowed to bet in any location in which they are located. Whilst we may take steps to block bets from people located in certain jurisdictions (e.g. the US), the availability of Betfair from any particular jurisdiction does not mean that it is legal to use Betfair from that jurisdiction.
    • You will be in breach of the terms if you interfere in any way with the IP address of the computer you are using to use Betfair or otherwise take steps to prevent us from correctly identifying the geographical location of the computer you are using.
    • Customers agree that they will transfer to Betfair any rights (e.g. copyright) that may subsist in any bets placed by them on Betfair. Betfair owns all price and betting data on the Exchange. We re-iterate that Customers cannot use or copy this data without Betfair's prior approval.
    • The rules that apply to the Betfair Forum are now incorporated into the Terms and Conditions. In particular Betfair shall not be liable for any defamatory postings made by you and you agree to indemnify Betfair against any loss suffered by Betfair as a result of your postings.
    • Any other terms giving access to Betfair are also incorporated into the Terms and Conditions, for example the user terms for Betfair Mobile.
    • We will be introducing a new betting dispute policy shortly, however you agree that you will exhaust any dispute policy that Betfair has in place before taking your complaint to any relevant regulator or recognised betting dispute resolution body.
